Background:

Greystar Development East, LLC, and Lowe's Home Centers, LLC have submitted a Development Agreement for Marlowe Sunrise, a proposed mixed-use development generally located at the southwest corner of N. University Drive and W. Oakland Park Boulevard, as shown on the attached location map. The Property is currently zoned B-2, Community Business District, and B-3, General Business District, and is designated Commercial on the City's Future Land Use Map. Concurrently with the Development Agreement, the Applicant has applied to rezone the Property to a Planned Development District (PDD) and for Site Plan approval.

The Development Agreement provides for the redevelopment of a portion of the Property with a six-story multifamily residential building containing up to 270 dwelling units on the western portion of the site currently occupied by existing strip shopping center, while maintaining the existing daycare facility and Lowe's Home Improvement store. The Development Agreement also requires that 39 of the 270 residential units be reserved for moderate income households earning no more than 120% of the Area Median Income (AMI) for 30 years via a Declaration of Restrictive Covenant.

The major provisions of the Development Agreement include:

  • Establishes three development parcels consisting of:
    • Parcel A: Proposed multifamily residential development
    • Parcel B: Existing daycare facility
    • Parcel C: Existing commercial building – Lowe’s Home Improvement store Permits on Parcel
  • A maximum building height of 60 feet (six stories) and up to 270 multifamily dwelling units with ground-floor residential amenities
  • Establishes the following residential unit mix for Parcel A:
    • One-bedroom units: 45% to 55%
    • Two-bedroom units: 40% to 45%
    • Three-bedroom units: 4% to 6%
  • Maintains the existing development entitlements for the daycare facility and Lowe's Home Improvement store
  • Identifies prohibited uses
  • Establishes required on-site and off-site improvements prior to the first Certificate of Occupancy for the Project:
    • Pending Broward County approval, reconfiguration of westbound left-turn lane on West Oakland Park Boulevard by approximately 50-feet by reducing the taper to 50-feet
    • Elimination of two (2) existing driveways cuts to the west of the main entry drive to Parcel A on W. Oakland Park Boulevard
    • Installation of an eight foot (8’) wide meandering pathway and landscaping extending from the westernmost property line east to the westernmost driveway
    • Installation of a new bench and trash receptacle along the new meandering pathway within the W. Oakland Park Boulevard right-of-way
    • Installation of new bicycle racks along the new meandering pathway within the W. Oakland Park Boulevard right-of-way
    • Facade improvements for the existing daycare located within Parcel B of the Marlowe Sunrise PDD to match colors and add non-structural architectural elements that are compatible with the proposed architectural scheme of the Marlowe Sunrise PDD residential uses, to the extent feasible given the ongoing operation
    • On-site plaza connecting to the existing pedestrian network within Parcel C
    • Contribution of $150,000 for replacement of the existing bus shelter along W. Oakland Park Boulevard with a City standard shelter
    • On-site public art installation in the Arrival Plaza valued at $25,000
    • On-site decorative walkway connecting to a pedestrian gate at the south boundary of Parcel A for future pedestrian connection to the planned greenway along the existing canal
  •  Parking requirements: 1.61 spaces per unit for residential use & maintains existing parking code requirements for the daycare and Lowe’s Home Improvement store
  • Site amenities:
    • Public Arrival Plaza with trellises, benches, decorative paving, tropical landscaping, and public art Pool Courtyard with BBQ pavilion, dining, and fire pit areas
    • Dog Run
    • Interior spaces: Co-working space, Gym, Club Room
  •  Authorizes the Community Development Director or designee to approve minor adjustments to site plan and building elevations consistent with administrative authorities provided in the Land Development Code

The Development Agreement meets the requirements of Section 16-109(e) of the Land Development Code and Sections 163.3220-163.3243 of the Florida Statutes. Staff recommends the approval of the Development Agreement.
