Background:

This settlement is related to a City employee workers’ compensation claim. The Claimant sustained a compensable on-the-job injury on September 13, 2024 (Claim No. 1290281). Staff and the City's workers' compensation counsel are recommending the City Commission approve a workers’ compensation settlement in the amount of $350,000.00 to be paid to claimant to settle all liabilities and verified claims including but not limited to all claims for any past and future medical expenses, all lost wages, all claimant's attorney's fees, and all lien and release costs related to Claim No. 1290281.  Approximately $280,000.00 of the settlement amount will be reimbursed to the City by the Florida Municipal Insurance Trust, who provides the City with excess workers' compensation insurance.

As part of the settlement, the City will agree to waive an obscure medical plan exclusion for past and future medical services related to claims from workers’ compensation settlements, but only while the City remains self-funded and the Claimant remains an active participant in the City’s medical plan. This additional settlement term is necessary because the settlement is largely related to lost wage exposure and the Claimant plans to move out of state. The waiver will help ensure the Claimant has access to future medical care with new physicians.

Staff recommends that the City Commission approve the settlement and authorize the City's workers' compensation counsel and Risk Manager to finalize and execute all related documents for this settlement.
