Background:

The City of Sunrise operates a stormwater system consisting of eighteen drainage basins that convey and treat stormwater before discharging into the regional canal system. Recently the City completed a comprehensive Stormwater Master Plan (SWMP) to evaluate the level of service, the capacity of the system, and provided recommendations of Capital Improvement Projects to improve the stormwater management within the City.

 

One of the recommended projects identified in the SWMP is the Basin 15 Drainage Improvements project. Drainage Basin 15 is located between NW 44th Street on the south, Commercial Boulevard on the north, Nob Hill Road on the east, and the South Florida Water Management District C-42 Canal on the west. The basin encompasses a total area of approximately 492 acres and overlays the City’s Industrial Park. Due to the size and complexity of Drainage Basin 15, the capital improvement project was proposed to be completed in multiple phases of drainage and culvert improvements.

 

On November 14, 2023, the City Commission approved Project Agreement 23-011-JR with Joseph Roles and Associates Inc. (JRA). for design, permitting, bidding services and construction management services of the Basin Drainage Improvements Project for the following culvert improvements: Culvert R15-100A NW 52nd Street, Culvert R15-80A NW 108th Avenue, Culvert R15-120A NW 53rd Street.  Due to the various locations, complexity and constructability, each culvert improvement will be bid and constructed separately.

 

The construction documents have been completed and the City of Sunrise, Utilities Department requires a qualified contractor to perform construction services for the Culvert Replacement R-15-100A, located at canal crossing of NW 52nd Street between NW 108th Avenue and NW 109th Avenue. The scope of work consists of, but is not limited to, replacement of the existing 60” culvert with double 48” x 76” elliptical concrete pipes and rerouting of the street drainage system. The work also includes utility relocations (water and sewer), bypass pumping, dewatering, and temporary sheet piling; demolition and replacement of culvert and drainage structures; roadway, curb, and sidewalk restoration; canal bank grading; and associated work including MOT, erosion control, paving, pavement markings, sodding  and other miscellaneous and incidental items to provide a complete project as specified.

 

On November 10, 2025, Bid No. 26-06-10-CM was issued for this project. A non-mandatory pre-bid meeting with a site visit was conducted on November 21, 2025, with four (4) prospective bidders in attendance. The bid opening took place on December 12, 2026, and seven (7) bids were received.

 

During the bid evaluation period, staff requested bid price confirmation from Heavy Civil Inc. Citing a mathematical/miscalculation error during their review, Heavy Civil, Inc. requested to withdraw their bid as certain work was not transferred to their final excel spreadsheet and thus not accounted for in their bid. In accordance with City of Sunrise, Code of Ordinances, Article V. Purchasing and Contracting, Section. 5-173. – Procurement of commodities or contractual services. “Withdrawal of bids; cancellation of awards. Withdrawal of inadvertently erroneous bids before award, shall be permitted under the following circumstances: a bidder alleging a material mistake of fact may withdraw its bid before bid award when there is reasonable proof provided by the bidder that a mistake was made and the intended bid cannot be ascertained with reasonable certainty. A bidder may not withdraw a bid for errors in judgment. If a bidder is permitted to withdraw its bid before award for a mistake of fact, no action shall be taken against the bidder or the bid security". After review, Procurement staff determined it was in the best interest of the City to permit withdrawal of the bid, as the submitted pricing was materially erroneous and would not result in a fair and reasonable award.

 

Following the evaluation of the remaining bids by the Purchasing Office, Utilities Department, and JRA, it is recommended to award the contract to the lowest responsive and responsible bidder, Westwind Contracting, Inc. (Westwind). Westwind’s bid price was approximately 15% lower than the Engineer’s Opinion of Probable Construction Cost (OPCC), while the second-lowest bidder’s submitted price was 3.23% below the OPCC. JRA conducted a detailed review of the bids received and determined that, despite being lower than the OPCC, the pricing is fair and reasonable and falls within an acceptable range of the OPCC. Additionally, a clarification and fact-finding meeting was held with Westwind to ensure a clear understanding of the project specifications and scope of work. Staff also obtained confirmation of pricing and secured an extension of the bid validity period from Westwind.

 

All references were favorable for Westwind's performance on other projects of similar type and scale with other entities. Additionally, Westwind’s performance on a previous lime sludge hauling contract with the City was also favorable.

 

Staff requests approval to award to Westwind Contracting, Inc. Following award by the Commission, the Contractor will be required to obtain acceptable Public Construction Bond, an acceptable Certificate of Insurance, and an executed Contract within the timeframe stipulated in the Notice of Award. The construction contract and associated construction documents are available at the Purchasing Office upon request.

 

The City did not receive responses from City of Sunrise vendors that could provide this service.

 

This project is partially funded with Resilient Broward Grant in accordance with the executed Interlocal Agreement approved by the City Commission on January 27, 2026, City Commission Meeting.
