| Background:
The City requires the services of special appellate counsel to represent the City in the City’s appeal of the recent trial court ruling in State of Florida v. Kayla Erin McFadden.
Because American Traffic Solutions, Inc. d/b/a Verra Mobility (Verra Mobility) and the City share a common interest in the outcome of the appeal, Verra Mobility has agreed to pay the legal fees incurred in the appeal and related proceedings. Pursuant to the attached tri-party Retainer Agreement, Verra Mobility will initially pay up to $75,000 for such legal services. If the appeal is not concluded at that point, the Weiss Serota law firm will notify Verra Mobility, provide a revised budget estimate for the completion of the appeal, and the parties will confer and determine whether to increase the budget.
City staff have reviewed the tri-party Retainer Agreement and recommend Commission approval.
