Background:
The first reading of the subject rezoning ordinance is to set the date of the quasi-judicial public hearing for second reading.
This is an application to rezone approximately 20 net acres from B-2 (Community Business District) and B-3 (General Business District) to PDD (Planned Development District), generally located at the southwest corner of N. University Drive and W. Oakland Park Boulevard as shown on the location map in the attached Staff Report. The property is designated Commercial on the City's Future Land Use Map. The proposed rezoning requires City Commission approval pursuant to Subsection 16-38(e) of the Land Development Code.
The applicant proposes to redevelop the western portion of the existing commercial site with a six-story multifamily residential building containing 270 dwelling units, which includes 39 moderate-income units affordable to households earning up to 120% of the Area Median Income (AMI), utilizing Broward County Land Use Plan (BCLUP) Policy 2.16.4 that provides for residential density without requiring a Land Use Plan Amendment. The 39 moderate-income units will be restricted for a minimum of 30 years through an Affordable Housing Declaration of Restrictive Covenant.
In addition, per Subsection 16-109(e) of the Land Development Code, upon application for rezoning to a PDD district, the applicant shall provide a Development Agreement and a Site Plan, which have been submitted under separate applications.
Staff recommends approval of the proposed rezoning from B-2 (Community Business District) and B-3 (General Business District) to PDD (Planned Development District), subject to the following conditions as listed below:
- The applicant shall provide an executed and recorded Unified Control Document approved by the City Attorney’s Office prior to issuance of a building permit for vertical construction or within 12 months of rezoning approval, whichever comes first.
- The applicant shall execute and record the Affordable Housing Declaration of Restrictive Covenant consistent with BCLUP Policy 2.16.4 prior to issuance of a building permit for vertical construction or within 12 months of rezoning approval, whichever comes first.
- Pending Broward County approval, reconfigure westbound left-turn lane on W. Oakland Park Boulevard by approximately 50-feet by reducing the taper to 50-feet.
City Commission approval of the associated Site Plan (SP-000508-2025) and Development Agreement (DEVAG-000510-2025).
Staff completed an open building permit and code violation search. There are multiple open building permits and five code violations. Two of the code violations are complied with liens on the Lowe's parcel and the other three are active cases with lien on the existing shopping center that is proposed to be demolished.
