Background:
A Development Agreement for the Westerra project, a 32-acre mixed use development proposed at the vacant site generally located along W. Sunrise Boulevard between Sawgrass Corporate Parkway and NW 136 Avenue as shown on the attached location map, was approved by the City Commission on March 27, 2018, via Resolution No. 18-42.
On February 27, 2024, the City Commission approved an Amended and Restated Development Agreement for Westerra Phase I via Resolution No. 18-42-24-A. The amendment primarily revised the legal entities executing the agreement and provided for the development of up to 750 high-rise residential units, 750,000 square feet of office space, 50,000 square feet of commercial space, and 300 hotel rooms, distributed among five (5) development pods within the site.
Ruby Centre Associates, LLC has submitted a Second Amended and Restated Development Agreement for Westerra Phase I, also known as Radius. The subject property is located within the Westerra Development of Regional Impact (DRI), is designated Local Activity Center (LAC) on the Future Land Use Map,and is zoned Planned Development District (PDD). An application to revise the Westerra Master Plan, as well as a Site Plan application for Pod 4 is being processed concurrently.
The Second Amended and Restated Development Agreement maintains the development plan for construction up to 750 high-rise residential units, 750,000 square-feet of office, 50,000 square-feet of commercial, and 300 hotel rooms distributed into five (5) pods.
The major revisions within the Second Amended and Restated Development Agreement are as follows:
- Modifies the maximum building height for parking garages such that the height of a parking garage shall not exceed those of the principal building it serves;
- Relocates a pocket park from the southwest to the northeast corner of Pod 4;
- Modifies the phasing to include timing requirements for Community Linear Greenway along the eastern perimeter of the project;
- Provides for the removal of the existing surface parking lot and access road to be concurrent with the development of Pod 2, 3, 4, or 5;
- Clarifies the Iconic Element/Feature is for public art and amends the voluntary contribution for public art to include a specific amount of $100,000 for the Westerra Phase I project; and
- Modifies driveways to Pods on roadways internal to the project.
In addition, the Development Agreement maintains the following previous staff authorizations:
- Authorizes the Director of Community Development to approve minor deviations from the Design and Development Guidelines. The Development Agreement meets the requirements of Section 16-109(e) of the Land Development Code and Sections 163.3220-163.3243 of the Florida Statutes. Staff recommends approval of the Development Agreement.
