Background:
The City of Sunrise is required by federal regulations, under the Clean Water Act and the Florida Department of Environmental Protection (FDEP), to acquire and maintain an active MS4 Permit to regulate stormwater discharges to waters of the State. The City currently participates in an Interlocal Agreement (ILA), as a co-permittee, with Broward County for the National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Permit No. FLS000016.
Sunrise is one of twenty-six Broward County municipalities that operate as a co-permittee under this joint system-wide framework. The current Interlocal Agreement is set to expire on September 30, 2026. As such, Broward County Public Works and Environmental Services Department (PWESD), through its Environmental Permitting Division, has prepared the attached Interlocal Agreement, to continue performing centralized regional technical activities on behalf of the co-permittees. These activities include surface water quality monitoring, sampling, and regional public outreach programs required to maintain compliance with the latest five-year NPDES MS4 permit cycle.
Each municipality's cost-share for the County's regional technical activities is calculated based on the 2020 population and outlined in Exhibit B of the attached Interlocal Agreement. Funding for the City’s portion is available and will be provided by the Stormwater Utility Fund. Continued participation as a co-permittee in this Interlocal Agreement provides significant cost savings to the City by leveraging joint County-wide resources, eliminating the duplication of local sampling efforts, and ensuring regulatory compliance.
City staff reviewed the attached Interlocal Agreement and request permission of the City Commission to allow the Mayor to execute the Interlocal Agreement.
