A Resolution of the City of Sunrise, Florida, approving a "Vacation of Drainage & Utility Easement;" providing for Recording of Documents; and providing an effective date. City Manager Mark Lubelski. Shannon Ley, Director of Community Development.

In 1982, a twelve-foot drainage & utility easement was granted to the City for drainage, water, and wastewater infrastructure as shown on the attached location map.  In 2025, the City of Sunrise staff reviewed engineering plans and issued engineering permits for the Broward Health Free Standing Emergency Room project that provided for drainage, water, and wastewater infrastructure.  The new infrastructure is designed and being constructed outside the existing twelve-foot drainage & utility easement and therefore, the existing easement is no longer needed. New utility easements will be granted as part of the project for the appropriate infrastructure.

Subsequent to the engineering plan approval for the Broward Health Freestanding Emergency Room, Lochrie & Chakas, P.A. on behalf of Broward Health, submitted an application for a Vacation of Easement for the existing drainage & utility easement (attached OR BK 11501, PG 547). There are no approved or permitted site plans or engineering plans on file with the City that show existing or proposed drainage or utility infrastructure within the subject easement. As such the existing twelve-foot drainage & utility easement is no longer required. The drainage & utility easement proposed to be vacated is illustrated on the attached location map, and more specifically described in Exhibit A.

Concurrently with this Vacation of Drainage & Utility Easement, staff is presenting two other items for vacation of easements within the subject Broward Health project. One of such applications is for a duplicate of this drainage & utility easement that was recorded as a separate instrument and requires a separate vacation of easement.

Staff has reviewed the application to vacate the existing Drainage & Utility Easement (OR BK 11501, PG 547) and finds it is no longer needed, and recommends approval of such vacation.
