Background:

Section 163-3225(1), Florida Statute, requires the local government to conduct two (2) public hearings for this agreement, one of which may be before the Local Planning Agency (LPA).
CC/WV Sunrise, LLC as a successor-in-interest to Windsor Investments (Sunrise Golf & Country Club), LLC and Windsor Investments (Fairway Isles), LLC has submitted an Amended and Restated Development Agreement for the residential development at the former Sunrise Golf & Country Club site located east of N. University Drive and south of W. Oakland Park Boulevard between Aragon Boulevard, East Sunrise Lakes Drive and NW 30 Place, as shown on the attached project location map.
The original Development Agreement for the proposed residential development was approved, via Resolution No. 21-17, on February 9, 2021. On July 13, 2021, via Resolution No. 21-17-21-A, the effective date of the original adopted Resolution for the Development Agreement was amended to be retroactive to the February 9, 2021 date, as opposed to upon the approval of future development applications; no changes were made to the Development Agreement itself.
The Amended and Restated Development Agreement covers the same area that totals approximately 160 acres, and includes revisions associated with recent project improvements for the proposed residential community with a maximum of 900 residential dwelling units. All previous commitments including the associated infrastructure improvements, height limitations, development buffers and setbacks, and public park remain unchanged as shown by the attached redlined version of the Amended and Restated Development Agreement.
The property is designated Irregular (9 du/ac) and Commercial Recreation on the City’s Future Land Use Map. The applicant is concurrently seeking to rezone the property from CR (Commercial Recreation District), RM-25 (Higher Density Multiple-family Residential District) and RM-10 (Low Medium Multifamily Residential District) zoning districts to a Planned Unit Development District (PUD), as well as a Master Plan approval. In addition, the applicant currently has a Plat application and Site Plan application under review. These applications are expected to be heard before the City Commission in the upcoming months.
The proposed Amended and Restated Development Agreement modifications include, but are not limited to the following:
- Acknowledgement of the formation of the Community Development District (CDD);
- Acknowledgement of Future Land Use Plan amendment approval to Irregular (9 DU/Ac) Residential;
- Revision to nomenclature of when the Public Park dedication shall occur; the actual time of when the Public Park shall be dedicated remains the same;
