Background:
In 1984, The Ben Ash Plat was approved as recorded in Plat Book 124, Page 15, in the Public Records of Broward County. As part of the plat approval, a 10-foot Utility Easement on Parcel B of the plat was dedicated to the public for uses indicated.
Lochrie & Chakas P.A. submitted an application to vacate the ten (10) foot Utility Easement dedicated by plat on behalf of the Broward Health. Broward Health received Site Plan approval for the Broward Health Freestanding Emergency Room and has commenced construction activities that encompasses Parcel B of the Ben Ash Plat as well as two adjacent parcels to the east. Previously existing FP&L infrastructure within the easement has been removed or relocated. There are no approved or permitted site plans or engineering plans on file with the City that show existing or proposed utility infrastructure within the subject easement. As such the existing 10-foot platted utility easement is no longer required.
Concurrently with this Vacation of Utility Easement, staff is presenting two (2) other items for vacation of easements within the subject Broward Health project.
Staff has reviewed the application to vacate the existing 10-foot Utility Easement dedicated by plat and finds it is no longer needed, and recommends approval of such vacation. The applicant will also require Broward County approval of the vacation of Utility Easement since it was dedicated by plat.
